PROJECT INFORMATION

Notice to Bidders: Qualified bidders are invited to submit bids for Project as described in this Document according to the Instructions to Bidders.

Project Identification: Northwest Resiliency Park

Project Location: 1113-1131 Madison Street, Block 103 Lot 7 and 1201 Madison/1200 Adams Street, Block 107 Lot 1, 12th Street between Jefferson Street and Madison Street, Hoboken, New Jersey.

Owner: City of Hoboken, 94 Washington Street, Hoboken, NJ 07030.

Engineer: Engineering and Land Planning, 140 West Main Street, High Bridge, New Jersey 08829.

Project Description: Project generally consists of the construction of a one-million-gallon subsurface tank, green infrastructure (GI), stormwater infrastructure, deep foundations systems, open spaces, a turf field, basketball court, play areas and structures, community building, café building, fountain, ice rink,retaining structures, utilities and related infrastructure.  The site is contaminated and will require capping and treatment.  This project requires Sustainable SITES v2 minimum certification of “Silver”.

BID SUBMITTAL AND OPENING

Owner will receive sealed bids until the bid time and date at the location indicated below. Owner will consider bids prepared in compliance with the Instructions to Bidders issued by Owner, and delivered as follows:

Bid Date: 5/14/2019

Bid Time: 2:00 PM, local time.

Location: City Hall, Office of the City Clerk, 94 Washington Street, Hoboken, New Jersey 07030.

Bids will be there after publicly opened and read aloud.

BID SECURITY

Bid security shall be submitted with each bid in the amount of 10% percent of the bid amount but not in excess of $20,000.00 in the form of a certified check, cashier's check or bid bond payable unconditionally to the City of Hoboken. When submitting a Bid Bond, it shall contain Power of Attorney for full amount of Bid Bond from a surety company authorized to do business in the State of New Jersey and acceptable to the City.  The check or bond of the unsuccessful bidder(s) shall be returned as prescribed bylaw (N.J.S.A. 40A:11-24).  The check or bond of the bidders to whom the contract is awarded shall be retained until a contract is executed and the required performance bond or other security is submitted.  The check or bond of the successful bidder shall be forfeited if the bidder fails to enter into a contract pursuant to N.J.S.A. 40A:11-21.

Bidders shall comply with Surety Bonds Circular 570 (N.J.A.C. 7:22-3.17(g).

If the bidder is a corporation or a partnership, the bidder, in conformance with N.J.S.A. 52:25-24.2, shall submit with its Bid, a statement setting forth the names and addresses of all stockholders who own a ten percent (10%) or greater interest in the firm.

N.J.S.A. 40A: 11-23.3 permits a bidder to request withdrawal of a bid, due to a mistake on the part of the bidder, within five business days after a bid opening.  After this time, no bids may be withdrawn fora period of 60 days after opening of bids. Owner reserves the right to reject bids and to waive minor informalities and irregularities, in accordance with applicable law.

PRE-BID CONFERENCE

A prebid conference for all bidders will beheld at City Hall, 94 Washington Street, Hoboken New Jersey on 4/18/2019 at 10:00 a.m., local time. Prospective bidders are encouraged to attend.

DOCUMENTS

Bidding Documents maybe examined and/or obtained at the offices of Engineering & Land Planning, Engineering and Land Planning, 140 West Main Street, High Bridge, New Jersey 08829, between the normal business hours of 9:00 AM and 5:00 PM.

Documents will be provided to prime bidders only; only complete sets of documents will be issued.  Only prime bidders who request contracting documents will receive addenda or notifications. Hard copies of the Contract Documents will not be available for purchase.

A fee of$100.00 payable to Engineering and Land Planning will be required.

TIME OF COMPLETION AND LIQUIDATED DAMAGES

Bidders shall begin the Work on receipt of the Notice to Proceed and shall complete the Work within the Contract Time. Work is subject to liquidated damages.

FUNDING

The Owner is seeking financing for this project through the New Jersey Environmental Infrastructure Trust, known as the New Jersey Infrastructure Bank (I-Bank) and the New Jersey Department of Environmental Protection. The successful bidder must comply with all the provisions of N.J.A.C. 7:22-9 et. seq. for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SEDs). The successful bidder must comply with the Project Plan provided in Section 008001 for fulfilling SED utilization requirements.

This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust, nor any of their departments,agencies or employees is, or will be, a party to this contract or subcontractor any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10. Wage rates for this Project are also subject to the Davis Bacon Act Wage Determinations as amended.

Bidders are required to comply, where applicable, with the requirements of N.J.S.A. 10:5-31 et seq., N.J.A.C. 17:27-1 et seq., New Jersey Statutes Title 19 Fair and Open Process, the City of Hoboken Chapter 20A Fair and Open Process, and all other applicable laws.

N.J.S.A.52:25-24.2 P.L. 1977, c.33 (Disclosure of Ownership) and N.J.S.A. 52:32-44 P.L.1999, c. 39, as amended by P.L. 2009, c. 315, (NJ Contractor Business Registration Act).

The successful bidder shall be required to comply with the provisions of the New Jersey Prevailing Wage Act or the Davis Bacon Act, N.J.S.A. 34:11-56.25 et seq Chapter 150 of the Laws of 1963, effective January 1, 1964 and the Public Works Contractor Registration Act (N.J.S.A. 34:11-56.48).
