The Open Public Records Act (OPRA) is a series of substantial changes to the state law that governs the public’s access to government records. It was enacted to give the public greater access to records maintained by public agencies in New Jersey by balancing the public’s interest in government records, respect for personal privacy, and the efficient process of government.

Make a Request

You can submit OPRA requests to the City Clerks office in person or mail during normal business hours.

You can also submit the requests via email but it MUST be scanned & attached in the email: cityclerk@hobokennj.gov or you can fax it to the City Clerk’s office: (201) – 420-2085.

Typical Response Time

The City strives to satisfy each request in a timely manner. Records which are not readily available or which will require a search of records will be made available as soon as possible. In such cases the requestor will be provided with an interim report within seven (7) business days indicating how much time will be required to provide the complete records.

Rate Schedule

Our office can provide records in printed or electronic form. Printed records are by far the most commonly requested and quickest to be processed.

Balancing Public Interests and Private Rights

The term “public records” includes those records determined to be public in accordance with N.J.S.A. 47:1A-1. The term does not include employee personnel files, police investigation records, public assistance files or other matters in which there is a right of privacy or confidentially or which is specifically exempt by law.

OPRA Legislation

The applicant must certify that he or she has not been convicted of any indictable offense under the laws of this State, any other state or the United States and is not seeking government records containing personal information pertaining the victim or the victim’s family as provided by N.J.SA. 47:1A-1 et seq.

Where a legal determination must be made as to whether records are “public records” as provided by law, the request will be reviewed by the Municipal Attorney. If your request has been denied, a statement of the procedures for the appeal will be attached to said notification. Appeals can be brought before the Government Records Council or to the New Jersey Superior Court, as provided by N.J.S.A. 47:JA-I et seq.
